Terms and Conditions of Use

1. General terms and conditions of use of the platform and the services offered.

- Use of the events.netexplo.com website (hereinafter the "Website and services") implies full acceptance of the general conditions of use described below. These terms of use may be modified or supplemented at any time, and users of the site are therefore invited to consult them regularly. 
- This site is only accessible by registration. 
 - The site is regularly updated by HappeningCo, owner of the Netexplo brand. In the same way, the general conditions of use can be modified at any time: they are nevertheless binding on the user who is invited to refer to them as often as possible in order to become aware of them. 

2. Presentation of the site.

- This site is the property of HappeningCo, SAS registered in the Paris Trade and Companies Register under number B447906165 and SIRET under number 447.906.165.000.17 and whose head office is located at 264, du Faubourg Saint-Honoré, 75008 Paris, 
 - The current version of the site was co-designed by HappeningCo and developed by Infinite Square SAS, 33 rue du Faubourg Saint-Antoine 75011 Paris, which is responsible for the maintenance of the site. Hosting is provided by Microsoft Azure in Amsterdam. 
 - The Director of Publication is Thierry Happe, HappeningCo, 264, Rue du Faubourg Saint-Honoré, 75008 Paris, France.  

 3. Description of the services provided.

- The purpose of the site is to provide access to Netexplo events, both face-to-face and remote (invitations and sending of communications, issuing of badges, access to content during and after the events, etc.). 

4. Contractual limitations on technical data.

- The minimum configuration required to access the site is as follows: Works on Firefox, Google Chrome, Safari and Internet Explorer 8+ ; On mobile or tablet devices, the platform works on the browsers integrated into the operating systems HTML5 video (iOS) 
- The user of the site undertakes to access the site using hardware that meets the configuration requirements described above and does not contain viruses. 

5. Intellectual property.

- The names Netexplo, HappeningCo, Netexplo Observatory are trademarks duly registered by the company HappeningCo. 
 - HappeningCo is the owner of the intellectual property rights or holds the rights of use on all the elements accessible on the site, notably the texts, images, videos, graphics, icons and sounds. - Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the site, whatever the means or process used, is forbidden, except with the prior written authorisation of HappeningCo. 
 - Any unauthorised use of the site or of any of the elements it contains will be considered as constituting an infringement and will be prosecuted in accordance with the provisions of articles L.335-2 and following of the Intellectual Property Code. 

6. Limitations of responsibility. 

 - HappeningCo cannot be held responsible for direct and indirect damage caused to the user's equipment when accessing the site and resulting either from the use of equipment that does not meet the specifications indicated in point 4, or from the appearance of a bug or incompatibility. 

7. Protection of personal data. 

 - The Access Codes allow the User to identify himself and to connect to the subscribed services offered on the platform. These Access Codes are personal and confidential. They can be modified on line by the User or by HappeningCo at the request of the User (forgotten or hacked access code). The User is entirely responsible for the use of the Access Codes concerning him/her. In the absence of proof to the contrary, any connection to the Site or transmission of data using the User's Access Codes shall be deemed to have been made by the User. 
- The User undertakes to keep his or her Access Codes secret and shall not disclose them in any form whatsoever to third parties. In this respect, the User has the possibility of ensuring that at the end of each session, he/she can explicitly disconnect. 
- HappeningCo undertakes to respect the legal and regulatory provisions applicable to personal data and in particular the provisions of the General Regulation (EU) 2016/679 on data protection of 27 April 2016 ("RGPD") as well as the law n°78-17 of 6 January 1978 relating to information technology, files and freedoms as amended and the law for Confidence in the Digital Economy of 21 June 2004. 
- HappeningCo undertakes to respect the confidentiality and security of personal data relating to users of its website. For more information on this processing, please consult the Privacy Policy of the site. 
- HappeningCo undertakes to put in place all the technical and organisational measures necessary for the security of the Data, taking into account the state of knowledge, the costs of implementation and the nature, scope, context and purposes of the processing as well as the risks, whose degree of probability and gravity varies, for the rights and freedoms of individuals, in order to guarantee a level of security adapted to the risk. 

8. Hypertext links. 

 - The insertion of hypertext links to any part of the site is forbidden without prior written authorisation from HappeningCo. 

 - This site contains a certain number of hypertext links to other sites, set up with the authorisation of HappeningCo. However, HappeningCo does not have the possibility of checking the content of the sites visited, and consequently will not assume any responsibility for this. 

 9. Cookies. 

 - Browsing on this site leads to the installation of so-called functional cookies on the user's browser. A cookie is a small file which does not allow the user to be identified, but which records information relating to the navigation of a computer on a site. 
- Refusal to install a cookie may make it impossible to access certain services. However, the user can configure his computer to refuse the installation of cookies. For more information, please consult the Cookies Policy of our subcontractor Inwink. 10. Applicable law and jurisdiction. Any dispute relating to the use of the site is subject to French law. The competent courts of Paris shall have exclusive jurisdiction.
